1. Agreement to Terms
These Terms of Service (“Terms”) govern your use of Connect Home Care's website, services, and all related content, products, and services (collectively, the “Services”). By accessing and using Connect Home Care's Services, you agree to be bound by these Terms. If you do not agree to abide by the above, please do not use this service.
2. Non-Medical Services Disclaimer
IMPORTANT DISCLAIMER
Connect Home Care provides non-medical home support services only. We are NOT a licensed healthcare provider and do NOT provide nursing, clinical medical care, medication administration, wound care, dressing changes, injections, diagnostic services, or any other regulated health services.
Our caregivers provide companionship, personal care assistance (bathing, dressing, grooming support), activities of daily living support, light housekeeping, meal preparation, and non-clinical household support only.
If you require medical care, nursing services, or any regulated health services, you must contact your healthcare provider, local healthcare services, or emergency services as appropriate. All clients should maintain regular contact with their physician and coordinate with appropriate healthcare professionals for all medical needs.
3. Scope of Services
Connect Home Care provides home support services as agreed upon between you and the Company. All services are provided on an as-is basis. We do not guarantee specific outcomes or results. Services include only the non-medical support activities explicitly discussed during the consultation and detailed in your support plan.
All caregivers employed or engaged by Connect Home Care are independent contractors or employees engaged to provide companionship and non-medical support services. Caregivers are not medical professionals and should not be relied upon for medical advice or clinical care.
4. Payment Terms
Billing: Services are billed at the hourly rate agreed upon during your consultation. Payment is due as specified in your service agreement.
Payment Methods: We accept major credit cards and other payment methods as specified on the website. Payment information is processed securely.
Late Payments: If payment is not received by the due date, we may suspend services until payment is made in full.
Refunds: Refunds for services already rendered are not available. Cancellation policies are detailed in Section 5.
5. Cancellation and Termination
Client Cancellation: Clients may cancel services with 48 hours notice. Cancellations made with less than 48 hours notice may result in a cancellation fee as specified in your service agreement.
Company Right to Terminate: Connect Home Care reserves the right to terminate services immediately if: (a) payment is not made; (b) client conduct is abusive, threatening, or unsafe; (c) the client misrepresents their support needs; or (d) continued service provision poses a risk to the caregiver or others.
Notice of Termination: In non-emergency situations, the Company will provide reasonable notice of termination to allow for transition of care support.
6. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, CONNECT HOME CARE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THESE TERMS, YOUR USE OF THE SERVICES, OR ANY SERVICES PROVIDED, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Connect Home Care's total liability for any claim arising out of or relating to these Terms or the Services shall not exceed the amount paid by you for Services in the 12 months preceding the claim.
7. Client Responsibilities
Accurate Information: You agree to provide accurate, complete, and current information about your support needs, health status, household conditions, and emergency contacts. You are responsible for updating this information as it changes.
Safe Environment: You are responsible for maintaining a safe home environment for caregivers. This includes freedom from abuse, threats, or hazardous conditions.
Medical Coordination: You are responsible for maintaining contact with your healthcare provider and coordinating all medical care independently. You must inform us of any significant health changes.
Respect for Caregivers: You agree to treat caregivers with respect and not engage in abusive, threatening, or discriminatory behavior.
8. Intellectual Property Rights
All content on the Connect Home Care website, including text, graphics, logos, images, and software, is the property of Connect Home Care or its content suppliers and is protected by international copyright laws. You may not reproduce, distribute, transmit, or display any content without our written permission.
9. Confidentiality
Connect Home Care respects your privacy. Any personal information shared with us will be kept confidential and used only for the purpose of providing services. Our Privacy Policy, available on our website, outlines how we collect, use, and protect your information.
Caregivers agree to maintain the confidentiality of client information. Any breach of confidentiality may result in immediate termination of employment or engagement and potential legal action.
10. Modifications to Terms
Connect Home Care reserves the right to modify these Terms at any time. Changes will be effective upon posting to the website. Your continued use of the Services following any modifications constitutes your acceptance of the revised Terms. We encourage you to review these Terms regularly.
11. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Province of Nova Scotia, Canada, and the federal laws of Canada applicable therein, without regard to conflicts of law principles. Both parties agree to submit to the exclusive jurisdiction of the courts located in Nova Scotia.
Nothing in these Terms shall be interpreted as consenting to the jurisdiction of any court outside Nova Scotia, except as required by law.
12. Dispute Resolution
Before initiating legal proceedings, the parties agree to attempt to resolve disputes through good faith negotiation. If negotiation fails, the parties may pursue mediation as a next step. Only if negotiation and mediation are unsuccessful may either party pursue legal action.
13. Independent Contractor Status
The relationship between Connect Home Care and clients is that of service provider and customer. Caregivers are either employees of Connect Home Care or independent contractors, not agents of the client. No partnership, joint venture, or employment relationship is created between the parties.
14. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be severed, and the remaining provisions shall continue in full force and effect. The severed provision shall be modified to the minimum extent necessary to make it valid and enforceable.
15. Entire Agreement
These Terms, together with any Privacy Policy, support plan, and service agreement, constitute the entire agreement between you and Connect Home Care regarding the Services and supersede all prior understandings and agreements. No oral representations or understandings shall modify these Terms.
